Fintentional, Inc. dba Hence (“Fintentional,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and otherwise process information when you access or use our website located at usehence.com (the “Website”), our Services, and when you otherwise interact with us in any way.

By accessing or using the Website or the Services, you agree to the collection, use, and disclosure of information as described in this Privacy Policy and our accompanying Terms of Service, which incorporates this Privacy Policy by reference. Capitalized terms not defined in this Privacy Policy have the meanings given to them in our Terms of Service.

1. Information We Collect

When you visit or interact with the Website or use our Services, we collect the categories of information described below. Where applicable, we rely on this information to provide the Services, comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.

1.1 Information You Provide to Us

We collect the following categories of personal information directly from you, such as when you create an account, join our waitlist, enter information in the Services, contact us, or otherwise interact with the Services:

• Identity and Account Information. Your name, email address, and authentication credentials when signing up to use our Services or contacting us. We use this information to create and secure your account, communicate with you about the Services, respond to inquiries and requests, and send administrative or service-related notices.
• Profile and Financial Information. Household information; demographic information (such as age and marital status); financial goals; and financial information you provide, such as income, expenses, investment balances, product holdings, and service providers. Please review our Regulation SP Privacy Notice for a description of our processing and disclosure activities regarding the non-public personal information that we collect from and about you in connection with opening and servicing your account on the Services.
• Chat Content. The prompts, questions, messages, and other content you submit through our artificial intelligence features, including our chat feature, your chat history, and the responses generated for you (“Inputs” and “Outputs,” as defined in our Terms of Service), which we use to generate responses and personalized guidance. Please do not submit through these features information that is not needed for your use of the Services.
• Other Information You Choose to Provide. Any other information you choose to share with us in the course of using the Website or the Services. We do not require you to provide personal information to browse the Website, and we collect it only when you choose to provide it.

1.2 Information We Collect Automatically

We, and our service providers, may automatically collect the following categories of information when you visit, use, or navigate the Website or the Services (collectively, “Usage Data”):

• Log and Device Data. IP address; browser type and language; referring and exit pages and URLs; date and time of access (timestamps); time spent on pages; pages viewed; device type; operating system and version; and similar technical data.
• Cookies and Similar Technologies. Information collected through cookies, pixel tags, and similar tracking technologies, as described further in Section 3 below.
• Analytics and Monitoring Data. We use third-party analytics providers, such as PostHog for product analytics, Sentry for error monitoring, and Braintrust Data for AI monitoring, to help us understand how users interact with the Services, diagnose issues, and evaluate performance. These providers may use their own cookies and similar technologies to collect this data. We may add to or change these third-party analytics services from time to time. If you opt out of any service, you may not be able to use the full functionality of the Website or the Services.

1.3 Information from Third Parties

Linked Financial Accounts. If you choose to connect a financial account, we receive information from your financial institution through Plaid (and may use additional providers in the future), including account identifiers, balances, transactions, and holdings. We collect this information only after you authorize the connection. Plaid’s handling of your information is governed by Plaid’s own privacy policy. You may disconnect a linked account at any time in the Services, as described in Section 5.4.

Data Enrichment. We may receive information about you from data enrichment providers, such as Acxiom, to supplement the information we hold.

1.4 Aggregated and De-Identified Information

We may aggregate or de-identify information so that it no longer identifies you personally, and we maintain and use de-identified information in accordance with applicable law. We may use aggregated or de-identified information to operate, maintain, and improve the Website and our products and Services, including to train, develop, and improve the artificial intelligence models and features used in the Services. We may share this aggregated or de-identified information with affiliates, agents, and business partners, or disclose it publicly, for any lawful business purpose.

2. How We Use Your Information

We use the information described above for purposes that include:

• Providing, operating, maintaining, and improving the Website and Services, including generating personalized financial planning insights and guidance using artificial intelligence technologies;
• Processing and fulfilling requests, orders, or transactions;
• Communicating with you, including responding to inquiries and sending service, administrative, and (where permitted) marketing communications;
• Personalizing your experience with the Services;
• Monitoring and retaining Inputs and Outputs to evaluate the quality, safety, and performance of our artificial intelligence features, prevent misuse, and enforce our Terms of Service;
• Monitoring, analyzing, and improving the performance, security, and functionality of the Website and our Services;
• Detecting, preventing, and addressing fraud, abuse, security incidents, and technical issues; and
• Complying with applicable law, legal process, and our contractual obligations, and enforcing our agreements and rights.

3. Cookies and Other Tracking Technologies

Cookies are small data files that a website stores on your browser or device so that it can “remember” information about your visit. We use both session cookies (which expire when you close your browser) and persistent cookies (which remain until deleted) to operate the Website, remember your preferences, and understand how the Website is used.

Most browsers allow you to control cookies through their settings, including blocking or deleting them. Because cookies allow you to take advantage of certain Website features, we recommend leaving them enabled. If you disable cookies, some parts of the Website may not function properly. See Section 5.2 for information about Do Not Track and Global Privacy Control signals.

4. How We Share Your Information

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising. We disclose information only as described below.

• Vendors, Service Providers, and Contractors. We share information with third parties that perform services on our behalf, such as hosting, analytics, customer support, and communications, subject to appropriate confidentiality and data-protection obligations.
  • We share Inputs and other information you provide, including chat content and financial information, with artificial intelligence and large language model providers, currently including Anthropic, OpenAI, and xAI, which process that information on our behalf to respond to your requests and generate Outputs and personalized guidance. We may change these providers from time to time.
• Affiliated Entities. We may share information with our parent companies, subsidiaries, joint ventures, or other entities under common control with us.
• Corporate Transactions. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction.
• Legal Compliance and Protection of Rights. We may disclose information (i) when required by law, subpoena, or other legal or governmental process, or (ii) when we believe disclosure is necessary to protect the rights, property, or safety of Fintentional, our users, or others.
• With Your Consent. We may share information for any other purpose disclosed to you at the time of collection or with your consent.

5. Your Privacy Choices and Rights

5.1 Email Marketing Communications

You may opt out of marketing and non-transactional emails by clicking the “unsubscribe” link at the bottom of any marketing email from us. We will process opt-out requests within a commercially reasonable time. Note that we may still send you transactional or administrative messages related to your use of the Services.

5.2 Do Not Track and Global Privacy Control

Some browsers offer a “Do Not Track” (“DNT”) setting, and some browsers or extensions send a “Global Privacy Control” (“GPC”) signal. There is no common industry standard for responding to these signals. At this time, we do not respond to DNT or GPC signals, though we may update this practice in the future as standards evolve, and where required by law, we will honor such signals as an opt-out preference.

You can manage cookies through your browser settings, as described in Section 3.

5.4 Linked Accounts and Account Deletion

You may disconnect a linked financial account at any time in the Services, which stops our collection of new data from that account. You may also delete your account entirely through the Services. Account deletion is processed after a seven (7) day cancellation window, during which you may cancel the deletion request; after that window, deletion will proceed, subject to any information we are required or permitted by law to retain.

6. California: Shine the Light

Under California Civil Code Section 1798.83, California residents with an established business relationship with us may request information once per year about the categories of personal information we shared with third parties for their direct marketing purposes in the preceding calendar year. 7. Data Security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee the absolute security of information transmitted to us. In particular, email communications may not be secure, and you should exercise discretion in deciding what information to send to us electronically.

8. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. If you delete your account, we will delete your personal information after the seven (7) day cancellation window described in Section 5.4, except as required or permitted by law. When personal information is no longer needed for these purposes, we take reasonable steps to delete, de-identify, or securely archive it.

9. International Data Transfers

The Website, the Services and their servers are operated in the United States. If you access the Website or the Services from outside the United States, your information will be transferred to, stored, and processed in the United States or other jurisdictions that may have data protection laws different from those of your home jurisdiction. By using the Website or the Services, you consent to this transfer.

10. Children’s Privacy

The Services are intended only for individuals aged 18 or older and are not directed to children. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will take reasonable steps to delete that information. Parents or guardians who believe we may have collected such information should contact us using the details in Section 13.

11. Third-Party Websites and Links

The Website and the Services may contain links to third-party websites (“External Sites”). We do not control the privacy practices or content of any External Sites, including those operated by our business partners, advertisers, or sponsors, and we are not responsible for them. We encourage you to review the privacy policy of any External Website before providing information to it.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be indicated by updating that date, and, where required by law, we will provide additional notice. Your continued use of the Website or Services after any changes take effect constitutes acceptance of the revised Privacy Policy. We encourage you to review this page periodically.
