Terms of Service

These Terms of Service ("Terms") are an agreement between you and Fintentional, Inc. ("Fintentional," "we," "us," or "our"), a Delaware corporation, and govern your use of Hence — our websites, applications, and related services (together, the "Services"). By creating an account, joining the waitlist, or using the Services, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 18 years old and reside in the United States to use the Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate.
2. Early access and the waitlist
The Services are in an early-access period. Signing up adds you to a waitlist, and we grant access at our discretion. Features may change, be interrupted, or be discontinued at any time, and we may reset or remove data associated with pre-release features with reasonable notice where practicable.
3. Your account
You are responsible for your account credentials and for all activity under your account. Keep your credentials confidential and notify us promptly at legal@usehence.com if you suspect unauthorized use.
4. Not financial, tax, or legal advice
The Services provide information, analysis, and educational guidance to help you think about your finances, including content generated by artificial-intelligence models. The Services do not provide investment, tax, accounting, or legal advice, and nothing in the Services is a recommendation to buy, sell, or hold any security or other asset. Fintentional is not a registered investment adviser, broker-dealer, tax advisor, or law firm, and no fiduciary relationship is created by your use of the Services. AI-generated content can be inaccurate or incomplete. Review important decisions with a qualified professional who knows your circumstances.
5. Connected accounts and third-party services
You may connect financial accounts to the Services through Plaid Inc. By connecting an account, you grant Fintentional and Plaid the right to access and transmit your account information as described in our Privacy Policy and agree that your information will be handled in accordance with the Plaid End User Privacy Policy. Data we receive from financial institutions and other third parties may be delayed, incomplete, or inaccurate, and we are not responsible for it.
6. License and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. You agree not to:
- copy, modify, distribute, sell, or lease any part of the Services, or reverse engineer them except where the law permits;
- access the Services with automated means (such as scraping or bulk data extraction) or attempt to probe or breach their security;
- use the Services to violate any law, infringe anyone's rights, or misrepresent your identity;
- use another person's account or share your account with others.
7. Intellectual property and feedback
The Services, including their design, software, and content (other than your own information), are owned by Fintentional and its licensors and are protected by intellectual-property laws. If you send us feedback or suggestions, we may use them without restriction or compensation.
8. Fees
The Services are currently offered without charge during early access. We may introduce paid features or subscriptions in the future; if we do, we will disclose pricing before you incur any charge.
9. Termination
You may stop using the Services or delete your account at any time. We may suspend or terminate your access at any time, including for violation of these Terms or where the early-access program ends. Sections 4, 7, and 10–14 survive termination.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY GUIDANCE WILL PRODUCE ANY PARTICULAR FINANCIAL OUTCOME.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINTENTIONAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold Fintentional harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.
13. Dispute resolution; arbitration; class-action waiver
Any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. You and Fintentional each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing legal@usehence.com within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Delaware.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Continuing to use the Services after changes take effect means you accept the updated Terms.
